Payment and Access Terms

Free Plugin Access:

The Image ReSizer Pro Max plugin is provided free of charge. While this plugin does not require a payment, its use is strictly governed by all other sections of this Agreement, including Licensing, Usage Restrictions, and Limitation of Liability.

All Products Own Outright (One-Time Payment):

This option allows users to purchase a perpetual license for all ProSizes Software premium products via a single, one-time payment. This grants indefinite access to the software without the need for recurring subscription fees.

Annual Subscription:

Our yearly subscription grants access to ProSizes Software's premium services for 12 months, starting from the date of purchase.

Subscription Renewal:

For Annual Subscription holders, your subscription will automatically renew each year unless canceled before the renewal date. The annual fee will be charged to your chosen payment method. (This does not apply to "Own Outright" purchases).

Subscription Management:

Subscription holders can manage settings or update payment methods through their account profile. ProSizes Software reserves the right to adjust subscription prices with prior notice.

Refund Policy:

Refunds are not available for unused portions of a subscription term or for "Own Outright" one-time payment purchases once the software has been accessed or downloaded.

Agreement to Terms:

By subscribing, purchasing a one-time license, or downloading free tools, you agree to these Terms of Service.

I. Software Definition

1.1. The term "ProSizes Software" encompasses the products Room Designer Pro, Mockup Generator Pro, Image Resizer Pro, the Image ReSizer Pro Max plugin, and any future updates thereof.

II. Acceptance of Terms

2.1. Access to the ProSizes Software website constitutes acceptance of these Terms of Service, adherence to applicable laws and regulations, and the responsibility to comply with local laws. ProSizes Software content is protected by applicable copyright and trademark laws.

III. Service Engagement

3.1. Access to the website Prosizes.com and transaction engagement signifies participation in the "Service". These terms apply to all site users including browsers, customers, merchants, vendors, and content contributors.

IV. Licensing

4.1. Grant of License: This Agreement grants the Licensee a non-exclusive, non-transferable right to use ProSizes Software for mockup creation and image resizing for both personal and commercial uses. This license is valid for the duration of the active subscription or indefinitely for "Own Outright" purchasers.

4.2. Strict Usage Restrictions: The Licensee is unequivocally barred from using the Software to create, develop, or aid in the creation or development of any products or services that directly compete with or mimic those of ProSizes Software. The Licensee is also strictly forbidden from transferring, reselling, demonstrating, or distributing the Software under any circumstances that could benefit competitors or contribute to the creation of competing products, especially if such actions involve individuals linked to ProSizes Software's rivals. Moreover, the Licensee is obligated to avoid any application of the Software that could be construed as harmful or counterproductive to the interests of ProSizes Software.

4.3. Ownership: All titles, ownership rights, and intellectual property rights in the Software remain with ProSizes Software.

4.4. No Transfer of Rights: The Licensee cannot sublicense, assign, or transfer the granted rights to any third party.

4.5. Compliance with Terms: The Licensee must comply with this Agreement, understanding that failure may lead to license termination and potential legal action.

V. Disclaimer

5.1. ProSizes Software is provided "as is" without warranties, including the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Accuracy, reliability, or results of use are not guaranteed.

VI. Limitation of Liability

6.1. ProSizes Software is not liable for damages, including data loss, profit loss, or business interruption from software use or inability to use, even if advised of such possibilities.

VII. Revisions and Errata

7.1. Materials on Prosizes.com are not guaranteed to be accurate, complete, or current and may change without notice. Continued use indicates acceptance of these terms.

VIII. External Links

8.1. ProSizes Software is not responsible for linked website contents and does not endorse them. User discretion is advised.

IX. Service Modification

9.1. ProSizes Software reserves the right to modify or discontinue any part of the service or content without notice.

X. Pricing

10.1. Users agree to current terms, acknowledging that prices are subject to change without notice. ProSizes Software is not liable for price changes or service suspensions.

XI. Product Representation

11.1. ProSizes Software strives for accurate product representation but cannot guarantee monitor color and image accuracy. Product, service, or information quality or service error correction is not warranted.

XII. Billing and Account Information

12.1. Users agree to provide accurate and complete transactional and account information.

XIII. Indemnification

13.1. Users agree to indemnify and hold harmless ProSizes Software and its affiliates from third-party claims arising from user violations of these Terms, applicable laws, or rights.

By using the ProSizes Software (including the Image ReSizer Pro Max plugin), subscribing to our services, or purchasing an "Own Outright" license, you agree to all the terms outlined above.
